Terms of use

This English version is provided for convenience. The Service is operated from France and governed by French law; in case of any discrepancy, the French version prevails.
1. Purpose
These terms of use (the "Terms") set out how the Koach mobile application and the koachapp.fr website (together, the "Service") may be accessed and used.
Creating an account or using the Service means you accept these Terms in full.
2. Publisher
The Service is published by Alexandre D'Agate, sole trader (entrepreneur individuel), registered with the Angers trade register under number 919 899 179, with registered office at 15 rue Joubert, 49100 Angers, France.

3. Access to the Service
3.1 Creating an account
Using the Service requires an account, created with an email address and a password or through a Google or Apple account.
You undertake to provide accurate information and to keep it up to date. You alone are responsible for keeping your credentials confidential and for any activity carried out from your account.
3.2 Minimum age
The Service is reserved for people aged 15 or over. If you are under 18, you declare that you use the Service with the consent of your legal representatives.
3.3 Availability
The Service is available 24/7, subject to maintenance, updates and technical incidents. Uninterrupted availability is not guaranteed.
4. Description of the Service
Koach lets you, among other things, build training sessions, follow them live, record your performances and body measurements, review statistics, follow programs and share your activity with other users.
Features evolve: some may be added, changed or removed without this giving rise to any compensation.
The Service is funded by advertising. Personalised advertising is subject to your consent, collected on first launch and changeable at any time from the settings.
5. Health warning
Koach is a training log, not a medical device.
The sessions, programs, statistics and suggestions it offers are not medical advice, a prescription, or personalised guidance from a healthcare professional or a qualified coach.
Before starting or resuming physical activity — in particular if you have a medical history, an injury, are pregnant or are undergoing treatment — consult a healthcare professional. You train under your sole responsibility and remain the judge of the intensity and the suitability of the exercises you perform. Stop any session immediately if you feel pain or discomfort.
6. User-published content
6.1 Responsibility
You alone are responsible for the content you publish (text, photos, sessions, comments). You warrant that you hold the necessary rights over that content and that publishing it infringes no third-party right.
6.2 Licence
You retain ownership of your content. You grant the publisher a non-exclusive, royalty-free licence to host, reproduce and display that content, solely as needed to operate the Service and for as long as it remains published.
6.3 Prohibited content
Prohibited content includes in particular unlawful, hateful, discriminatory, harassing, violent, sexual or deceptive content, as well as the promotion of dangerous practices, doping substances or disordered eating behaviours.
7. Moderation and reporting
The Service provides reporting, hiding and blocking tools. Any reported content may be reviewed and, where appropriate, removed.
The publisher may remove content that is manifestly unlawful or contrary to these Terms, and suspend or close the account concerned — without notice in the event of a serious breach.
8. Content designed with the help of artificial intelligence
Some programs in the catalogue were drafted with the help of artificial intelligence tools, then reviewed and published by the publisher. No generation is triggered by users.
Like any training content, these programs still have to be adapted to your situation: the warning in section 5 applies in full.
9. Intellectual property
The Service, its brand, its interfaces, its databases and its own content are protected. No reproduction, extraction, adaptation or reuse is permitted without prior written consent, beyond normal use of the Service.
10. Liability
The publisher takes reasonable steps to keep the Service running properly. It cannot be held liable for damage resulting from use that does not comply with these Terms, from a failure to heed the health warning, from an act attributable to a third party, or from force majeure.
Nothing in these Terms excludes the publisher's liability in the event of personal injury or of gross or wilful misconduct.
11. Deleting your account
You can delete your account at any time from the application. Deletion results in your data being erased or anonymised as described in the privacy policy.
12. Personal data
How your data is processed is described in the privacy policy.
13. Changes to the Terms
These Terms may be amended. In the event of a substantial change, you will be informed by appropriate means before it takes effect.
14. Governing law and disputes
These Terms are governed by French law.
In the event of a dispute, an amicable solution will be sought first, by writing to alexandre@koachapp.fr. Failing agreement, the French courts have jurisdiction.
